Policies & terms

Everything covering your account, your money and your clients' data. Written to be read, not skipped.

Terms & conditions

These terms govern your use of Thavosh, operated by [Registered entity name], [Address], GSTIN [GSTIN] ("we", "us"). By creating an account you agree to them. If you're accepting on behalf of a gym or company, you confirm you're authorised to bind it.

1. Who can use Thavosh

You must be 18 or older. Coaches and gyms are responsible for holding any certification, licence or registration their local law requires. We don't verify professional competence beyond the basic profile checks described at signup.

2. Your account

Keep your credentials confidential. You're responsible for activity under your account, including trainers you invite on a team plan. Tell us immediately at [security@thavosh.in] if you suspect unauthorised access.

3. Subscriptions, billing and taxes

  • Plans are billed in advance, monthly or yearly, in Indian Rupees.
  • Prices shown are inclusive of applicable taxes unless stated otherwise; a GST invoice is issued for every payment.
  • Founding-cohort pricing applies for as long as the subscription stays active and uninterrupted.
  • Subscriptions renew automatically until cancelled under our cancellation policy.
  • If a payment fails we may retry and, after 7 days, restrict access until it clears.

4. Free period

Founding-cohort accounts get three months free with no card required. We'll tell you before the free period ends. If you don't choose a plan, the account moves to read-only rather than being charged.

5. Your clients' data

You own the client records, plans and notes you put into Thavosh. For that content you are the data fiduciary and we are your processor: we handle it on your instructions to provide the service. You're responsible for having a lawful basis to collect it and for any health information your clients share with you.

6. Acceptable use

Don't use Thavosh to send unsolicited bulk messages, to impersonate anyone, to upload content you don't have rights to, to reverse-engineer the service, or to break any messaging or payment provider's rules. We may suspend accounts that put our messaging or payment integrations at risk.

7. Health disclaimer

Thavosh is software for delivering coaching. It is not a medical device and does not provide medical, nutritional or diagnostic advice. Programming decisions are the coach's. Clients should consult a qualified professional before starting any exercise or diet programme.

8. Third-party services

Messaging, UPI payments and hosting are provided by third parties under their own terms. We're not liable for their outages, policy changes or fees. Payments made directly to your own UPI ID are between you and your client; we record the reference and issue the receipt.

9. Intellectual property

The platform, its templates and its exercise library remain ours. You keep everything you create. White-label branding lets you present the portal as yours; it doesn't transfer ownership of the underlying software.

10. Suspension and termination

You can close your account at any time. We may suspend or end an account for non-payment, for a serious breach of these terms, or where required by law — with notice wherever we reasonably can. Export windows are set out in the cancellation policy.

11. Liability

To the extent permitted by law, our total liability in any 12-month period is limited to the fees you paid us in that period. We're not liable for lost profits, lost clients or indirect losses. Nothing here excludes liability that can't lawfully be excluded.

12. Governing law

These terms are governed by the laws of India. The courts at [City], [State] have exclusive jurisdiction. We'll always try to resolve a dispute by talking first — write to [legal@thavosh.in].

13. Changes

We'll give at least 14 days' notice by email before material changes take effect. Continuing to use Thavosh after that means you accept the updated terms.

Privacy policy

This explains what we collect, why, and what you can ask us to do about it. It follows the Digital Personal Data Protection Act, 2023.

What we collect

  • Account data — name, email, phone, business name, branding you upload.
  • Client records you enter — names, contact details, plans, logs, progress notes and any photos your clients share with you.
  • Payment references — UPI transaction references, amounts and dates. We do not store card numbers or UPI PINs.
  • Usage data — device, browser, IP, pages viewed and feature usage, for security and product decisions.

Why we use it

To run your account and portal, deliver plans and messages, record payments, provide support, keep the service secure, meet tax and legal obligations, and — only with your consent — send product updates. We do not sell personal data and we do not use your client records to train models.

Who we share it with

Only processors who help us operate: cloud hosting, messaging provider, payment and invoicing tools, email delivery, error monitoring. Each is bound by contract to use the data only for us. The current list is on the data & security section. We also disclose where the law requires it.

How long we keep it

Account and client data for as long as your account is active, then 90 days after closure to allow recovery. Invoices and tax records for 8 years as required. Backups roll off within 35 days.

Your rights

You can access, correct, or erase your data, withdraw consent, nominate someone to act for you, and complain to the Data Protection Board. Write to our Grievance Officer, [Name], at [grievance@thavosh.in] — we respond within 30 days. If your coach entered your data, ask them first; we'll help them action it.

Cookies

We use strictly necessary cookies for login and security, and privacy-friendly analytics to count visits. No advertising trackers.

Children

Thavosh isn't for under-18s. A coach training a minor must hold verifiable parental consent and record it in the client's file.

Refund policy

The three-month free period exists so you can decide before paying anything. After that, here's exactly where a refund applies.

Setup or migration help
Non-refundable once the work has been delivered.

How to request one

Email [billing@thavosh.in] from your account email with the invoice number. We acknowledge within 2 business days and, once approved, refund to the original payment method within 5–7 business days. Your bank may take a few days more to show it.

Payments your clients make directly to your UPI ID are not ours to refund — those are between you and your client. Please raise a chargeback with us before your bank; it's faster and we'll usually agree.

Cancellation policy

No phone call, no retention script. Cancelling takes two clicks in Billing settings.

What happens when you cancel

  • Your plan stays fully active until the end of the period you've already paid for.
  • Automatic renewal stops immediately; you won't be charged again.
  • Scheduled follow-ups keep running until the period ends, so no client is left mid-programme without warning.
  • At the end of the period the account becomes read-only — you can still view and export.

Your data after cancelling

  • Full CSV export of clients, plans, logs and payment history stays available for 30 days.
  • We keep the account recoverable for 90 days in case you come back.
  • After 90 days everything except tax records is permanently deleted.
  • You can ask for immediate deletion at any point by writing to [privacy@thavosh.in].

Team and gym plans

Elite plans can be cancelled the same way. Removing individual trainer seats mid-cycle takes effect at the next renewal. Annual gym contracts follow the terms in the signed order form where those differ from this page.

If we cancel

If we ever discontinue the service we'll give at least 90 days' notice, provide a full export, and refund any unused prepaid period.

Data & security

Your clients trust you with their bodies and their money. Here's how we look after the record of it.

HOSTING
Data is stored in Indian data-centre regions. Backups are encrypted and tested monthly.
ENCRYPTION
TLS 1.2+ in transit, AES-256 at rest. Passwords are hashed, never stored in the clear.
ACCESS
Least-privilege access for staff, MFA required, and every support access to an account is logged.
INCIDENTS
We notify affected accounts and the Data Protection Board within 72 hours of confirming a breach.

Sub-processors

Cloud hosting [provider], messaging [provider], payments and invoicing [provider], transactional email [provider], error monitoring [provider]. We give 30 days' notice before adding a new one that touches personal data.

Who owns what

You own your client data. We never contact your clients for our own marketing, never resell data, and never use it to train models. Export it to CSV whenever you like, on any plan.

Responsible disclosure

Found a vulnerability? Write to [security@thavosh.in] with steps to reproduce. We acknowledge within 2 business days, won't pursue legal action for good-faith research, and will credit you once it's fixed.
